Order about amendments in the Order of the Minister of Culture and Sport of the Republic of Kazakhstan No. 407 dated December 22, 2015 “On approval of the Rules of awards for non-government organizations”

According to the subparagraph 2-2) of the Article 4-1 of the Law of the Republic of Kazakhstan dated April 12, 2005 “On the state social order, grants and awards for non-government organizations in the Republic of Kazakhstan” ORDER:

1.Amend the order of the Minister of Culture of Sport of the Republic of Kazakhstan No.407 dated December 22, 2015 “On approval of the Rules of awards for non-government organizations” (registered in the Ministry of Justice of the Republic of Kazakhstan No. 12664 dated December 30, 2016, published January 16, 2016 in the legal information system of Regulatory Legal Acts of the Republic of Kazakhstan “Adilet”) the following changes:

Rules of awards for non-government organizations, as approved of this order, should be reworded in accordance with annex to this order.

 

2. The Committee for Civil Society Affairs of the Ministry for Religious Affairs and Civil Society of the Republic of Kazakhstan as prescribed by law to provide:

 

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan, provide its copies in both hard and electronic versions for the official publication in the periodic printed publications and in Electronic standard control bank of regulatory legal acts of the Republic of Kazakhstan;

3) publication of this order on the web-site of the Ministry for Religious Affairs and Civil Society of the Republic of Kazakhstan;

4) within ten working days after state registration of the present order in the Ministry of Justice of the Republic of Kazakhstan, provide the information of the execution of activities as prescribed by paragraphs 1), 2) and 3) of this paragraph to the Judicial Department of the Ministry for Religious Affairs and Civil Society of the Republic of Kazakhstan.

 

3. The control over the execution of this order entrust on the supervising Deputy Minister for Religious Affair and Civil Society of the Republic of Kazakhstan.

 

4. The present order comes into force on the expiry of ten calendar days of its first official publication.

Rules

of awards for non-government organizations

 

Chapter 1. General provisions 

 1. These Rules of awards for non-government organizations (hereinafter – the Rules) define the procedure of awarding for non-government organizations.

2. In these Rules the following main terms are used:

1) conflict of interests – situation when the personal interests of members of the competition committee might affect the objective decisions.

2) award for non-government organization (hereinafter – award) – money reward out of public funds to non-government organizations for their contribution in solving social challenges in governmental, sectoral and regional levels;

3) competitor for award – a non-government organization, which sent an application for the award to the authorized agency;

3. Award granted annually on a competitive base for non-government organizations registered in the Republic of Kazakhstan, who conduct activities in the areas, as prescribed in the subparagraph 1) of the paragraph 1 of Article 5 of the Law of the Republic of Kazakhstan dated April 12, 2005 “On the state social order, grants and awards for non-government organizations in the Republic of Kazakhstan” (hereinafter – the Law).

4. Award is granted by the authorized agency in the sphere of cooperation with non-government organization (hereinafter – authorized agency) in the nominations in accordance to the areas as prescribed by the Article 5 of the Law.

5. Nominations of non-government organizations for the award competition is conducted by a non-government organization itself, other non-government organizations and government agencies.

6. Renomination of the same non-government organization during three consecutive years is not allowed. The same non-government organization is not allowed to be nominated in more than one area.

7. Award in the same nomination can be given to one or couple of different applicants at the same time. In such case, the award is equally divided between them.

8. Minimum award size in one nomination is two thousandfold of monthly calculation index as established by the law on state budget in the corresponding financial year.

9. Organization of the award competition is funded at the expense of state budget assigned for these purposes in the corresponding financial year. 

 

 

Chapter 2.  Awarding procedure 

10. Call for applications for the nominations of non-government organizations for the award competition should be published on the internet resource of the authorized agency not later than July 1. Call shall include the list of required documents for the participation in the competition and the deadline of the applications.

11. Applications of the nominations of non-government organizations for the award competition shall be sent by the non-government organizations and government agencies to the authorized agency in both printed and electronic versions (CD or USB flash drive in PDF format) annually until midnight September 1 in Astana time.  

12. The compulsory list of documents for the award competition:

1) application (on the official letterhead of non-government organization or government agency signed by a chief executive officer or an acting chief, presenting relevance and importance of the activities of non-government organization according to the appendix 1 under these Rules and also the copies of founding documents no more than 2 pages in A4 format);

2) profile of the activities of non-government organization and its contribution in solving social challenges in governmental, sectoral and regional levels according to the appendix 2 under these Rules (no more than 2 pages in A4 format);

3) recommendations (at least two) of public representatives (other non-government organizations) about the activities of non-government organization;

13. In a case of providing the non-exhaustive list of documents, specified in the paragraph 12 of the present Rules, the authorized agency shall officially inform the applicant organization about a refusal of acceptance of documents.

14. For the purpose of consideration of applications the authorized agency shall establish the competition commission (hereinafter – the Commission).

15. The Commission shall be governed by the Constitution of the Republic of Kazakhstan, the laws of the Republic of Kazakhstan, other regulatory legal acts of the Republic of Kazakhstan and by the present Rules.

16. The composition of the Commission shall be approved by the order of a chief of authorized agency. Total number of the members of the Committee shall be no less than seven persons. The members of the Committee shall participate in the activities of the Committee without an option of substitution.

17. The composition of the Commission shall be formed from the representatives of the authorized agency, interested government agencies, public figures, experts on corresponding areas of the awards and consists of:

1) Commission chairman;

2) Vice-chairman of the Commission;

3) Secretary of the Commission;

4) Members of the Commission;

18. Within five working days after the deadline of the applications the authorized agency shall send to the members of the Commission the list of the nominees and a form of application on existence or absence of conflict of interests according to the appendix 3 of the present Rules.

19. If conflict of interests between a member of the Commission and a competitor of award is identified, the authorized agency shall decide the exclusion of this member from the composition of the Commission.

20. Commission chairman shall manage its activities, preside over the meetings, plan its work, exercise supervisory control of the implementations of its decisions. During the absence of the commission chairman, a vice-chairman shall perform his functions.  

21. Secretary of the Commission shall realize a meeting of the Commission, draw up a protocol of a meeting. Secretary shall not have voting rights.

22. Within ten working days after the deadline of the applications the authorized agency shall submit the applications for the Commission’s consideration and publishe the list of competitors for the award on its internet resource. 

23. Application processing for the award competition shall be divided into three stages:

1) first stage – application processing and making suggestions by the Commission to the authorized agency on the competitors for the award within twenty five calendar days of receiving the applications from the authorized agency.

2) second stage – making suggestions and providing a protocol of the Commission on the competitors of the award by the authorized agency to a session of the Coordinating Council on cooperation with the non-government organizations (hereinafter – the Coordinating Council) within twenty five calendar days of receiving the Commission’s suggestions from the authorized agency;

3) third stage – decision making on the awarding by the authorized agency within twenty calendar days of receiving recommendations from the Coordinating Council.

24. The Commission shall consider the applications for the award competition on the following criteria:

1) social contribution in the development of sector, region, republic;

2) experience of organization;

3) public recognition;

4) innovations;

5) presence of a competitor for award in the Database of non-government organizations as prescribed in the paragraph 5 of the Article 41 of the Law.

25. Consideration of the applications of the competitors for award shall be conducted on a session of the Commission by open voting with a majority vote. In case of equally divided votes, an application the Commission chairman voted for, or in his absence his vice-chairman, shall be deemed to be approved. The session shall be protocolized and considered to be legitimate if two-thirds of the members of the Commission are present. The proposals of the Commission on the competitors for the award shall be documented by a protocol and signed by the present members of the Commission.

26. The authorized agency shall provide its proposals on the competitors for the award and a protocol of the Commission to a session of the Coordinating Council for a making recommendations within twenty five calendar days of receiving proposals of the Commission from the authorized agency.

27. If any conflict of interests between a competitor for the award and a member of the Coordinating Council is present, the latter cannot participate in the voting.

28. The authorized agency shall decide the awarding according to the proposals of the Commission and the recommendations of the Coordinating Council. The Order of the authorized agency shall be published on its internet resource not later than December 1.

29. The authorized agency shall award to an award winner the diploma according to the appendix 4 of the present Rules and transfer the award to the bank account indicated in the profile of the non-government organization not later than December 20 of the corresponding year.
